وباعتبارنا باحثين وممارسين للقانون الدولي والعلاقات الدولية ودراسات الصراعات والسياسة ودراسات الإبادة الجماعية، فإننا ندعو الجمعية العامة للأمم المتحدة ودولها الأعضاء إلى عزل الدولة الإسرائيلية من الجمعية في أقرب وقت ممكن لحماية مصداقية وشرعية ميثاق الأمم المتحدة والنظام القانوني الدولي.

لقد أظهرت إسرائيل سياسة التحدي المستمر وعدم الاحترام للأمم المتحدة والنظام القانوني الدولي. وقد بدأ هذا بتجاهلها لحق العودة الفلسطيني المنصوص عليه في القرار 194 (III) (1948)، وسيادة الدولة الفلسطينية المنصوص عليها في القرار 181 (II) (1947). وعند قبول إسرائيل في الأمم المتحدة من خلال القرار 273 (III) (1949)، التزم الممثلون الإسرائيليون باحترام هذه القرارات التي اعتبرتها دول أخرى وممثلو الأمم المتحدة شروطًا للقبول. وعلى مدى العقود، أظهرت إسرائيل أيضًا ازدراءً لقرارات الجمعية العامة وكذلك الرأي الاستشاري لمحكمة العدل الدولية لعام 2004 الذي دعا إسرائيل إلى احترام حق الشعب الفلسطيني في تقرير المصير وأدان ضمها واستعمارها للأراضي الفلسطينية المحتلة. وكما أوضح الرأي الاستشاري الأخير لمحكمة العدل الدولية، فإن إسرائيل تعمل بشكل منهجي على إحباط حق الشعب الفلسطيني في تقرير المصير وحق العودة في انتهاك للقرارات المذكورة أعلاه. كما خالفت إسرائيل مراراً وتكراراً العديد من قرارات مجلس الأمن ، وهو ما يشكل في حد ذاته انتهاكاً للمادة 25 من ميثاق الأمم المتحدة. ووفقاً للمادة 6 من ميثاق الأمم المتحدة، يجوز للجمعية العامة، بناءً على توصية من مجلس الأمن، طرد إسرائيل بسبب انتهاكها المستمر لمبادئ ميثاق الأمم المتحدة.

تنتهك إسرائيل بشكل منهجي واجباتها تجاه الأمم المتحدة وتنتهك مرارًا وتكرارًا الحماية الممنوحة لهيئات الأمم المتحدة مثل الأونروا واليونيفيل. ويشمل ذلك التسبب في مقتل موظفي الأمم المتحدة وقصف منشآت الأمم المتحدة . وعلاوة على ذلك، ترفض إسرائيل بشدة التعامل مع آليات الأمم المتحدة من خلال عدم السماح بزيارات الأمين العام للأمم المتحدة والمقررين الخاصين للأمم المتحدة ولجنة التحقيق المستقلة التابعة للأمم المتحدة، من بين آخرين. داخل أروقة الأمم المتحدة، تصدر إسرائيل أيضًا بشكل متكرر بيانات تشهيرية ضد المنظمة. تعكس هذه الإجراءات تجاهلًا تامًا لأنظمة الأمم المتحدة وتشكل انتهاكًا للقانون الدولي.

لقد أدى إنكار إسرائيل المنهجي لحق الشعب الفلسطيني في تقرير المصير والاستيلاء المستمر على الأراضي الفلسطينية إلى منعطف تاريخي حرج حيث تواصل الدولة الإسرائيلية ممارسة الإبادة الجماعية والتطهير العرقي ضد الفلسطينيين بقوة وإصرار لا هوادة فيه. إن وجود الشعب الفلسطيني يتوقف على إنهاء الإفلات الإسرائيلي من العقاب، وأخيراً تحقيق حقه في التحكم في مصيره السياسي والاجتماعي والاقتصادي. بالإضافة إلى ذلك، أثارت خطورة الانتهاكات غير القانونية التي تسبب فيها إسرائيل تساؤلات خطيرة حول شرعية النظام القانوني الدولي ككل، مما يهدد استمرار سلامته.

إن الجمعية العامة والدول الأعضاء فيها قادرة، بل ومضطرة، على اتخاذ إجراءات ذات مغزى على الجبهتين ــ حق الشعب الفلسطيني في تقرير المصير وسلامة النظام القانوني الدولي ــ دون تأخير من خلال إقالة الحكومة الإسرائيلية من الجمعية، وفقاً لسلطة الجمعية في الموافقة على أوراق اعتماد وفود الدول الأعضاء.

إن إقالة وفد حكومة الولاية هو إجراء استثنائي، ولكن في هذه الحالة، يستند هذا الإجراء إلى سابقة – على وجه التحديد، إقالة حكومة الفصل العنصري في جنوب إفريقيا من الجمعية العامة في عام 1974 – وفي القانون. قبل خمسين عامًا، مارست الجمعية العامة سلطتها بموجب قواعد الاعتماد لإقالة وفد جنوب إفريقيا، وخلصت إلى أن الحكومة غير ممثلة وبالتالي غير شرعية بسبب فشلها في توفير التمثيل لسكانها السود الأصليين. وعلى الرغم من أن ممارسات الفصل العنصري في جنوب إفريقيا كانت محورية لهذا القرار، إلا أن إزالة الوفد الجنوب أفريقي كان أيضًا قائمًا ضمنيًا على حق تقرير المصير، والذي حُرم منه السكان السود في البلاد بطبيعة الفصل العنصري.

وكما أظهرت الرأي الاستشاري الصادر عن محكمة العدل الدولية في 19 يوليو/تموز 2024 بشأن العواقب القانونية لسياسات إسرائيل وممارساتها في الأراضي الفلسطينية المحتلة، فإن القضية المتعلقة بإقالة حكومة إسرائيل بسبب الافتقار إلى التمثيل قوية مثلما كانت في حالة جنوب أفريقيا، إن لم تكن أقوى.

وكما خلص الرأي الاستشاري، فإن الجمعية العامة والدول الأعضاء فيها ملزمة قانوناً بتحقيق حق الشعب الفلسطيني في تقرير المصير، لأن هذا الحق هو حق آمر وحق ملزم للجميع . ومن خلال التوصل إلى هذا الاستنتاج، فإن الرأي الاستشاري يمهد الطريق، من الناحية القانونية، لاستخدام عملية اعتماد الجمعية العامة للوفاء بهذه الالتزامات.

ونحن ندرك الخطوات التي اتخذتها الجمعية العامة ودولها الأعضاء بالفعل للوفاء بمسؤولياتها بموجب الرأي الاستشاري. وعلى وجه الخصوص، في 18 سبتمبر/أيلول 2024، أقرت الجمعية العامة قرارًا يدعو إسرائيل إلى الامتثال للرأي الاستشاري في غضون اثني عشر شهرًا على الأكثر من خلال “إنهاء وجودها غير القانوني في الأراضي الفلسطينية المحتلة دون تأخير” والتوقف عن “عرقلة الشعب الفلسطيني عن ممارسة حقه في تقرير المصير …”، من بين أمور أخرى، كما يدعو القرار “جميع الدول والأمم المتحدة ووكالاتها ومنظماتها المتخصصة، وكذلك المنظمات الإقليمية، إلى دعم ومساعدة الشعب الفلسطيني في تحقيق حقه في تقرير المصير في وقت مبكر والسعي بنشاط إلى اتخاذ خطوات لضمان التنفيذ الكامل للرأي الاستشاري وجميع قرارات الأمم المتحدة ذات الصلة”.

ونحن ندعو الجمعية العامة والدول الأعضاء فيها إلى مواصلة السعي إلى “التنفيذ الكامل للرأي الاستشاري” وتحقيق حق الشعب الفلسطيني في تقرير المصير من خلال اتخاذ جميع الخطوات اللازمة على الفور لإقالة الحكومة الإسرائيلية من الجمعية العامة.

إن السماح لإسرائيل بمواصلة المشاركة في الجمعية العامة في حين ترتكب مخالفات قانونية خطيرة تشكل تهديداً للسلم والأمن الدوليين في انتهاك لمبادئ ميثاق الأمم المتحدة من شأنه أن يؤدي إلى تفاقم أزمة الشرعية في النظام القانوني الدولي. وعلى النقيض من ذلك، فإن عزل الدولة الإسرائيلية يشير إلى أن الجمعية العامة، فضلاً عن الأمم المتحدة على نطاق أوسع، تظل ملتزمة بالدفاع عن وحماية الحقوق والمبادئ التي تأسست عليها الأمم المتحدة منذ ما يقرب من ثمانين عاماً.

As we mark the second year of Israel’s genocide, the fifty-seventh year of Israel’s occupation of the Gaza Strip and West Bank, including East Jerusalem, and the seventy-sixth year of Israel’s expulsion and ethnic cleansing of hundreds of thousands of Palestinians from historic Palestine, unseating Israel from the General Assembly would not only effectuate the legal responsibilities and obligations of the Assembly and its Member States, as outlined by the ICJ advisory opinion, but also bring a measure of accountability for Israel’s long-standing evisceration of the possibility for human flourishing and freedom for Palestinians. This action would represent a significant step toward the protection and liberation of the people of Palestine.
